1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and MonthlyDubai ("MonthlyDubai", "we", "us", "our"), the operator of the website located at www.monthlydubai.com.

By accessing our website, submitting any form, or engaging with our service in any way — including receiving communications via WhatsApp or email — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

These Terms apply to all visitors, users, and others who access or use the Service.

2. About Our Service

MonthlyDubai operates a free property matching service that helps individuals identify Dubai offplan real estate projects — including pre-launch, under-construction, and near-completion developments — that fall within their stated monthly instalment budget.

Our service includes:

  • A web-based form where you submit your name, WhatsApp number, email, monthly budget, and investment goal
  • Manual analysis and curation of relevant offplan projects based on your inputs
  • Delivery of a personalised property shortlist to your WhatsApp and/or email
  • Optional follow-up communications including new launches, market updates, and developer offers relevant to your budget

MonthlyDubai is not a property developer, mortgage lender, licensed financial advisor, or legal advisor. We are an information and referral service connecting prospective buyers with RERA-registered developer projects.

3. Eligibility

You must meet the following criteria to use our Service:

  • You must be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher
  • You must have the legal capacity to enter into binding contracts in your jurisdiction
  • You must provide accurate, truthful, and complete information when submitting our form
  • You must not use the Service for any purpose that is unlawful or prohibited by these Terms
  • Your use of the Service must comply with all applicable UAE laws and regulations

By using our Service, you represent and warrant that you meet all of the above eligibility requirements. If you do not, you must not access or use the Service.

4. Free Service & Our Business Model

MonthlyDubai is free to use for property seekers. You will never be charged for using our website, receiving property recommendations, or consulting with our team.

We earn revenue through referral arrangements with RERA-registered property developers and their authorised sales agents. When a user we referred completes a property transaction, the developer or agent pays us a commission. This commission is paid by the developer — not by you — and does not affect the purchase price you pay for any property.

Our referral relationships with developers may mean we have a financial interest in connecting you with those developers' projects. However, we are committed to matching you with projects that genuinely fit your budget and goals, regardless of developer relationships.

5. Nature of Information Provided

The property information we provide — including payment plan details, pricing, handover timelines, rental yield estimates, and project descriptions — is:

  • Provided by developers and their agents, and may not always reflect the final, legally binding terms of any property sale
  • Subject to change at any time and without notice by the developer
  • Intended as indicative information to help you explore your options, not as a definitive offer or contract
  • Accurate to the best of our knowledge at the time of sending, but we cannot guarantee its completeness or accuracy

All property sales are conducted directly between you and the developer or their authorised agent. MonthlyDubai is not party to any sale and purchase agreement and holds no responsibility for the terms or execution of any transaction.

6. Not Financial or Legal Advice

Important Disclaimer: Nothing on this website or in any communications from MonthlyDubai (including WhatsApp messages and emails) constitutes financial, investment, legal, or tax advice. Property investment involves significant financial risk, including the possible loss of invested capital.

Before committing to any property purchase, you should independently:

  • Consult a qualified financial advisor to assess your financial position and investment suitability
  • Seek independent legal advice from a UAE-licensed lawyer regarding the sale and purchase agreement
  • Conduct your own due diligence on the developer's track record, project registration, and escrow arrangements via the Dubai Land Department (DLD) and RERA
  • Assess your personal financial situation, including your ability to sustain monthly instalments if circumstances change
  • Understand all applicable fees including DLD registration fees (typically 4%), agency commissions, service charges, mortgage fees (if applicable), and maintenance costs

7. User Obligations

By using our Service, you agree to:

  • Provide accurate and complete information in all form submissions and communications
  • Not misrepresent your identity, financial capacity, or investment intentions
  • Not use the Service to collect information about properties or developers for competitive purposes
  • Not engage in any conduct that could harm MonthlyDubai's reputation or relationships with developers
  • Not attempt to access, copy, or reproduce content from our website without permission
  • Not submit multiple enquiries with fabricated details to test the system
  • Treat all information provided to you (including project details, pricing, and contact information) as confidential and for your personal use only
  • Notify us promptly if your contact details change so we can continue to serve you effectively

8. Property Developer Relationships

MonthlyDubai operates independently from all property developers. While we maintain referral relationships with many developers, we:

  • Do not have exclusive agreements that prevent us from recommending any developer's projects
  • Are not authorised representatives or agents of any developer unless explicitly stated
  • Cannot guarantee the performance, delivery timeline, quality, or financial stability of any developer or project
  • Are not responsible for any disputes between you and a developer arising from a property purchase
  • Encourage you to independently verify all developer claims through RERA's online portal and the DLD's transaction registry

All offplan projects in Dubai are legally required to be registered with RERA. We recommend verifying any project's registration status at www.rera.ae before committing to a purchase.

9. Intellectual Property

All content on the MonthlyDubai website — including but not limited to text, design, layout, graphics, code, and branding — is the intellectual property of MonthlyDubai and is protected by applicable copyright and trademark laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the website for personal, non-commercial purposes. You may not:

  • Copy, reproduce, or republish any content from this website without written permission
  • Scrape, harvest, or extract data from our website by automated means
  • Use the MonthlyDubai name, logo, or branding without prior written consent
  • Decompile, reverse-engineer, or tamper with any part of our website or systems

Property details, pricing, and brochures shared with you by MonthlyDubai originate from developers and are their intellectual property. These are shared with you for your personal use only and must not be redistributed.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONTHLYDUBAI PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

We specifically disclaim any warranties regarding:

  • The accuracy, completeness, or timeliness of any property information provided
  • The availability, uptime, or error-free operation of the website
  • The suitability of any recommended property for your specific needs or financial situation
  • Estimated yields, returns, or capital appreciation of any property
  • The financial stability or delivery capability of any developer we refer you to

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY UAE LAW, MONTHLYDUBAI, ITS OPERATORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Any financial losses resulting from a property purchase made based on information provided by us
  • Any project delays, developer insolvency, or failure to deliver an offplan property
  • Any inaccuracies in property pricing, payment plans, or specifications provided by developers
  • Any loss arising from your reliance on our property recommendations without independent professional advice
  • Any interruption or unavailability of the website or WhatsApp communication service

In no event shall our total liability to you exceed the amount of AED 100 (one hundred UAE Dirhams), representing the nominal value of our free service. This limitation applies whether the claim is based in contract, tort, negligence, or any other legal theory.

12. Indemnification

You agree to indemnify, defend, and hold harmless MonthlyDubai and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or inability to use the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including those of any developer
  • Any false or misleading information you provide to us or to developers
  • Any disputes arising from property transactions you enter into following our referral

13. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and protect your personal information. By using our Service, you consent to the collection and processing of your data as described in the Privacy Policy.

The Privacy Policy is incorporated into these Terms of Service by reference and forms part of this agreement.

14. Termination

You may stop using our Service at any time. To opt out of WhatsApp communications, reply "STOP" to any message from us. To opt out of email communications, use the unsubscribe link or email us at [email protected].

We reserve the right to refuse service, terminate access, or block communications from any user who:

  • Provides false or misleading information
  • Uses the Service for unauthorised or unlawful purposes
  • Engages in abusive behaviour toward our team or developers
  • Violates any provision of these Terms

Upon termination, Sections 5, 6, 9, 10, 11, 12, and 16 of these Terms shall survive.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we will endeavour to notify you via WhatsApp or email.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue using the Service and contact us to remove your data.

16. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, with particular reference to the laws of the Emirate of Dubai.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the Courts of Dubai, United Arab Emirates.

Before initiating any formal proceedings, you agree to attempt to resolve disputes informally by contacting us at [email protected]. We will attempt to resolve any complaint or dispute within 30 days of receipt.

If informal resolution is not possible, disputes may be submitted to the Dubai International Arbitration Centre (DIAC) for binding arbitration under its rules, with proceedings conducted in the English language in Dubai, UAE.
